This Agreement (the “Agreement”) is made by and between PARK HOLIDAYS UK LIMITED whose registered office is Glovers House, Glovers End, Bexhill-On-Sea East Sussex TN3 5ES (“the Owner”), and the PERFORMERS whose name and addresses are shown on the the Schedule attached (“the Performer/s”).

RECITALS

A. The Owner owns the copyright to certain materials relating to [ALL SHOW TRACKS ON SHOW MAGIC, AVAIA AND JINGLES] (“the Performance”) and is willing to allow the Performer/s to utilize such for the purpose of the Performance whilst the Performer/s performs the same on it’s Caravan/Chalet Parks (“ the Parks”)

NOW THEREFORE, in consideration of the mutual covenants and promises herein contained, the Performer/s agree as follows:

1. This Agreement shall be effective as of 1st January 2021 (Including any time EMPLOYED on Behalf of Park Holidays UK

2. The Owner hereby grants the Performer/s/s a non-exclusive right to utilise the copyright in the Performance only for the purpose of the production of the Performance on it’s Parks

3. All right, title and interest in the Performance, including without limitation, any copyright relating to the Performance or it’s production shall remain with The Owner.

4. The Performer/s/s agrees that it shall not reproduce or utilise the copyright in the Performance in any way outside the Parks

5. This Agreement shall be terminated by the Owner at any time on notice to the Performer or on such date as the Performer/s ceases to perform the Performance on the Parks, whichever is the earlier

6. This Agreement constitutes the entire agreement between the parties and all other prior negotiations, agreements, representations and understandings are superseded hereby.

7. This Agreement shall be construed and enforced in accordance with the laws of the England

IN WITNESS WHEREOF, the parties hereto have caused their duly authorized representatives to execute this Agreement.
